As the U.S. gets bombarded with an unprecedented surge of migrants along the southern border, Immigration and Customs Enforcement (ICE) records show a shocking decline in deportations during the Biden administration’s first year including dangerous criminals. Removals by the Homeland Security agency created after 9/11 to secure the nation’s borders fell nearly 70% last year, according to government figures obtained by the Center for immigration Studies (CIS) this month. The Washington D.C. nonprofit had to file a Freedom of Information Act (FOIA) request to access the alarming stats because the Biden administration hides them. In the last decade ICE’s annual reports have contained detailed enforcement and removal information, but under Biden the agency has omitted damaging specifics from its most recent annual report.

The records obtained by CIS tell a disturbing story of an administration with detrimental policies that are destroying immigration enforcement. For instance, in fiscal year 2021, ICE removals dropped by a ghastly 70% even as the number of migrants entering the U.S. through Mexico shattered records. Agency figures reveal 59,001 removals from both the border and the interior of the country in 2021 compared to 185,884 in 2020. In 2019, the last full year under Trump administration policies, ICE removed 267,258 illegal aliens, more than quadruple the amount deported in 2021. Even convicted criminals were given a pass by the Biden administration, the ICE records show. Removals of criminal aliens dropped 62% in 2021 to 39,149 compared to 103,762 in 2020. In contrast, 150,141 convicted criminals were removed by ICE in 2019. Last year the agency also slashed the number of aggravated felons that were removed by 43% over 2020, from 9,161 to 5,221. Among the alien offenders are murderers, human and drug traffickers as well as rapists.

The removal of criminal aliens from the interior also dropped substantially even though the administration claims it is prioritizing deporting those who pose a threat to public safety. The ICE records show that in 2021 only 26,210 criminals were removed compared to 48,606 the previous year. In its assessment of the recently obtained ICE figures CIS, the nation’s only think tank devoted exclusively to the research of U.S. immigration policy, writes that “the drop in enforcement activity in 2021 is directly attributable to the implementation of the Biden enforcement policies.” A breakdown of removals by fiscal year clearly illustrates a steep reduction in every category—interior, border, illegal immigrants with criminal convictions and aggravated felons—after Biden policies were adopted. One major factor is the administration’s effort to diminish a federal-local partnership known as 287(g) that notifies ICE of jail inmates in the country illegally so they can be deported after serving time for state crimes.

Homeland Security released more than 100,000 illegal immigrants caught at the border in April, according to new numbers the department provided to a federal judge Monday.

Customs and Border Protection, the agency that oversees U.S. boundaries, reported nabbing more than 230,000 border jumpers, marking the highest level of illegal activity yet under President Biden.

Experts said that’s the highest rate in history.

About half of those were quickly released, according to the data provided to the court.

About 20,000 others were turned over to Immigration and Customs Enforcement, the deportation agency, but just 263 of those were actually deported in April, the government said.

Nearly 8,000 more were released into communities, while the rest were still being held at the end of the month.

America First Legal, a conservative group staffed with senior officials from the administration of former President Trump, said when all the border releases are combined dating back to Mr. Biden’s early days in office, nearly 1 million migrants have now been caught and released into the country.

“These numbers are a stark depiction of how Biden has thrown open America’s borders,” said Stephen Miller, president of AFL and an architect of the Trump administration’s immigration policies.

The new filings came as part of an ongoing court case over the “Remain in Mexico” policy, which the Trump administration used to solve the previous border surge in 2019.

Mr. Biden had his administration cancel the policy upon taking office, but a judge said too many corners were cut. The judge has ordered the administration to revive the program, officially known as the Migrant Protection Protocols.

The Biden administration has yet to release a report that details the number of illegal immigrants removed from the United States in 2021, keeping the public in the dark about its handling of the immigration crisis.

Immigration and Customs Enforcement did not release its annual report in 2021, a departure from standard agency practice since at least 2011. In each of the last nine years, ICE released the report in the final weeks of the calendar year, most recently on Dec. 23, 2020 during the Trump administration. 

It is unclear whether ICE has completed the report, which provides a lengthy summary of the agency’s enforcement and removal operations, as well as immigration-related security threats. A spokeswoman for the immigration agency told the Washington Free Beacon a release date for the report has not been determined. 

The absence of the 2021 annual report has prompted outrage on Capitol Hill. Sen. Josh Hawley (R., Mo.) questioned the motives behind the White House's secrecy on the topic of immigration.

"During record-breaking levels of illegal immigration, DHS and ICE have taken steps to dismantle interior enforcement operations that keep our communities safe from criminal aliens," Hawley told the Free Beacon. "I’ve been calling for transparency into these radical policy changes for months. If ICE is intentionally hiding their annual report from the public, then it’s safe to assume it doesn’t show any improvement; it shows failure."

The administration's decision not to release the ICE report marks the latest example of Biden's failure to live up to transparency standards set by both its Democratic and Republican predecessors. The Free Beacon in November reported that the White House violated a congressional statute with its failure to release its report on the number of illegal immigrants in the United States. The 2021 fiscal year saw more recorded illegal border crossings than any time in U.S. history.

The federal government has pulled out of negotiations to pay massive settlements to illegal immigrant families who were separated at the border during the Trump administration, lawyers for the families said Thursday.

The American Civil Liberties Union, which had been leading negotiations on the reported $450,000 payments, said the talks have ended, though it didn’t know why.

“It’s hard to understand DOJ’s decision other than it was influenced by political considerations,” Lee Gelernt, an ACLU lawyer, told The Associated Press.

The Justice Department confirmed the breakdown. 

“After months of negotiations, the Biden Administration today abandoned the thousands of families torn apart by the prior administration,” said Tami Goodlette, Director of Litigation at the Refugee and Immigrant Center for Education and Legal Services.

The payments had become a political loser for the Biden team, with polls showing the public decidedly opposed to the idea.

Faced with that opposition, the ACLU launched an ad campaign in the Washington area this week to try to amp up pressure on President Biden to “repair” the damage done to the families.

“We are now officially putting the Biden administration on notice: Thousands of little children were separated from their parents and remain without justice,” ACLU Executive Director Anthony D. Romero said on Wednesday.

By Thursday, his organization was acknowledging the negotiations failed.

The Biden administration is considering paying illegal immigrant families who were separated at the border under former President Donald Trump’s policies up to $450,000 each, The Wall Street Journal reported on Thursday.

The illegal immigrants filed a lawsuit claiming the federal government detention resulted in major psychological trauma, according to the WSJ. Most of the families were made up of one parent and child who could receive around $1 million in payouts, though the amount could vary by family depending on the circumstances.

The American Civil Liberties Union (ACLU) represents some of the families involved in the lawsuit against the Departments of Justice, Homeland Security (DHS) and Health and Human Services, the WSJ reported. Around 940 families filed claims and the number of those who might qualify for the settlement is expected to be lower.

“President Biden has agreed that the family separation policy is a historic moral stain on our nation that must be fully remedied,” ACLU lead negotiator Lee Gelernt said, according to the WSJ. “That remedy must include not only meaningful monetary compensation, but a pathway to remain in the country.”

Almost lost in the distractions of the holiday weekend, on the night of December 29 up to 400 mostly Cuban migrants forced their way past Mexican immigration and over payment turnstiles on the Paso del Norte Bridge from Ciudad Juarez with a desire to force their way into downtown El Paso, Texas, according to news reporting. (Some video of the attempted incursion is here and here.)

U.S. Customs and Border Protection Mobile Field Force officers met them in riot gear and used concrete blocks tipped by concertina wire to block the onslaught mid-bridge as many of the migrants chanted "Biden! Biden!" Many demanded they be let in to live in the United States while they pursue asylum claims, instead of waiting in Mexico as required under various policies of President Donald Trump.

But with Trump still presiding, the blocked migrants with Biden on their minds were forced to listen to a recorded message broadcast over loudspeakers in Spanish and English warning that any further trouble would be met by force, arrests, and prosecution. That went on until the crowd dispersed at about dawn on December 30.

A source told the Center for Immigration Studies that CBP and Mexican authorities on the international bridge to the Del Rio, Texas, port of entry broke up another, smaller migrant formation demanding U.S. entry. Otherwise, the extent to which the attempted incursions occurred elsewhere along the southern border remains unclear at this time. But a question naturally arises from these events.

Do attempted mass incursions like these foreshadow a new flash point and tactic whereby untold tens of thousands of migrants inside Mexico can quickly test the new Biden administration on its many campaign promises of a kinder and gentler approach toward them? It bears watching.

Broader Implications of the Mass-Incursion Tactic for Incoming President Biden

This was not the first time CBP under Donald Trump has forcefully responded to surging migrants hoping to overrun the port of entry at El Paso and will almost certainly not be the last there or elsewhere.

Especially not now, judging by the chants and media interviews on the Paso del Norte Bridge this time about Biden's many immigration promises heard widely throughout the Americas and beyond, including an amnesty bill, an end to deportations, and reversal of Trump immigration policies during his first 100 days in office. While sharp analysts like my CIS colleague Mark Krikorian judge that Biden is likely to slow-boil the frog on some of his immigration promises for pragmatic political reasons, what was said on the international bridge during the recent confrontation confirms that migrants don't necessarily pay close attention to in-the-weeds political timing so much as big, broad, and directional messages.

The migrants on that bridge showed up with high expectations that the coming Biden administration somehow had already managed to swing open the gates as promised, never mind that Trump still has a few weeks to go.

The Mexican newspaper El Sol de Parral quoted Enrique Valenzuela, head of the Chihuahua State Council for Population and Migration, who was at the bridge last week, as saying a false social media rumor that the Americans would start letting migrants pass through that night easily sparked the event. He said that happened because "there is expectation, there is hope and there is enthusiasm in them [sic] who believe that with the change of administration comes new measures and that they will immediately enter and there will be new conditions that will allow them to request asylum."

Raul Pino Gonzalez of Havana was quoted at the bridge saying: "They should let us pass. We are calling out to Mexico and the U.S. and to Biden, the new U.S. president, to remind him of the presidential campaign promises he made. To make him aware we are here."

While events like this have happened before, time and place make these fresh mass-entry attempts very different. At issue with the mass-incursion tactic is whether the new administration will show similarly stiff, riot-gear resolve toward follow-on attempts, or let them pass to avoid the look of forceful confrontation.

In this Hobson's choice, the Biden administration would face the politically bitter prospect that violent confrontations would be among its first interactions with migrants. Should the administration choose the obvious alternative of letting such groups pass on the bridges or elsewhere, it would naturally follow that any successful breach would only inspire more, which could quickly spiral into a nationally hurtful border crisis, given the vast populations of frustrated, angry migrants in Mexico and far beyond at the moment.

Three white-collar judges in San Francisco are reopening the judge-created, 1997 border gateway that has allowed at least one million wage-cutting economic migrants to flood into the jobs, housing, and schools needed by blue-collar Americans.

“They’re basically saying, ‘Bring a child with you across the border and it is a get-out-of-jail card,'” said John Miano, a lawyer with the Immigration Reform Law Institute.

The December 30 decision by the judges on the Court of Appeals for the Ninth Circuit rejected a careful 2019 regulation by the Department of Homeland Security (DHS), which is intended to replace the 1997 Flores rules.

The Flores policy was set in 1997 by California Judge Dolly Gee in cooperation with pro-migration officials in President Bill Clinton’s administration and various pro-migration groups. The Flores court settlement enables and invites migrants to overwhelm U.S. border rules by first claiming asylum to prevent quick deportation and then using their children to get released after 20 days into U.S. workplaces.

The judges said President Donald Trump’s DHS regulation would wrongly end the 1997 Flores‘ catch and release policy:

Together, the DHS regulations regarding the release of accompanied minors and the revised definition of “licensed facility” dramatically increase the likelihood that accompanied minors will remain in government detention indefinitely, instead of being released while their immigration proceedings are pending or housed in nonsecure, licensed facilities. Effecting this change was one of the principal features of the [DHS] Final Rule. The government “strongly disagrees” with our holding in Flores [1997] that “the plain [catch and release] language of the Agreement clearly encompasses accompanied minors [with parents].”

“That’s the puzzling thing — how can a [1997 Cinton] arrangement like this be used to bind every future administration?” asked Miano. “That is nuts … it seems contrary to any democratic process.”

The judges did not bar DHS from holding migrant adults for long periods — but they also know that pro-migration Democrats and media outlets will emotionally slam the separation of children from their migrant parents after 20 days. For example, in October, President-elect Joe Biden declared:

Their kids were ripped from their arms and separated and now they cannot find over 500 of sets of those parents and those kids are alone. Nowhere to go. Nowhere to go. It’s criminal, it’s criminal.

Since his election, Biden has begun describing his pro-migration border policy as “family reunification.”

The judges’ decision allows Biden to keep the Flores gateway open during his first term — despite Trump’s regulatory closure — and use the 20-day rule to justify releasing many wage-cutting migrants into the jobs needed by blue-collar Americans. So far, very few white-collar journalists have defended the right of blue-collar Americans to their own national labor market.

Trump’s deputies did not release the DHS regulation until August 2019, 32 months after he took office. The late release — and slow judicial consideration — means that his deputies do not have time to get the Supreme Court to overturn the California judges’ veto

The judges insisted the Flores gateway has any impact on the flow of migrants through the obstacle course of dangers that lie between migrants’ homes and the jobs they want in the United States. “The crux of the government’s … argument is that an unprecedented increase in the number of minors arriving annually at U.S. borders warrants termination of the [1997] Agreement,” said the judges’ decision, released December 30. The decision continues:

According to the government, “irregular family migration” has increased by 33 times since 2013, and in 2019, more than 500,000 people traveling as families reached the southwest border.

The government has failed to demonstrate that the recent increase in family migration has made complying with the Agreement’s [1997] release mandate for accompanied minors “substantially more onerous,” “unworkable,” or “detrimental to the public interest.”

Amid the court’s claims, many migrants have told U.S. media outlets they brought their children up to the border to exploit Judge Gee’s Flores catch-and-release gateway.
